The terms you agree to when you use PepHaus.

IMPORTANT — PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN A BINDING INDIVIDUAL ARBITRATION PROVISION AND A CLASS ACTION WAIVER THAT AFFECT YOUR LEGAL RIGHTS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICES.
1. Acceptance of These Terms
These Terms of Service (“Terms”) form a binding agreement between you and Pephaus LLC, a Wyoming limited liability company doing business as “PepHaus” (“PepHaus,” “we,” “our,” or “us”). By visiting our website atthepephaus.com(and any affiliated domains we operate from time to time) (together, the “Site”), creating an account, submitting a medical intake, placing an order, or otherwise using any service we provide (collectively, the “Services”), you agree to these Terms, ourPrivacy Policy, ourHIPAA Notice of Privacy Practices, and ourRefund & Return Policy, each of which is incorporated by reference.
2. Who We Are
PepHaus is a LegitScript-certified telehealth platform that connects you with U.S.-licensed healthcare providers and U.S.-licensed compounding pharmacies for the evaluation, prescription, and fulfillment of certain medications. PepHaus itself is not a medical practice or pharmacy. Providers who deliver clinical services through the Services are independent practitioners exercising their own medical judgment; pharmacies that fulfill prescriptions are independent entities licensed in their respective states.
3. Eligibility
To use the Services, you must:
Be at least 18 years of age;
Be a resident of, and physically located in, a U.S. state where PepHaus’s partner pharmacies and providers are licensed to operate (see ourContact pagefor the current state list);
Have the legal capacity to enter into these Terms;
Not be barred from receiving the Services under the laws of the United States or any applicable jurisdiction.
By using the Services, you represent and warrant that you meet each of the above conditions.
4. Nature of the Services — Not Emergency Care
The Services are not appropriate for medical emergencies.If you are experiencing a medical emergency, a threat to life, or a mental-health crisis, call 911, the 988 Suicide & Crisis Lifeline, or your local emergency services immediately. The Services do not replace in-person primary or specialty care, and the providers with whom you are connected may decline to prescribe any medication at their professional discretion.
5. Medical Services Disclaimer
Licensed healthcare providers, not PepHaus, make all clinical decisions concerning your care. Submission of an intake does not establish a physician-patient relationship; that relationship is formed only when a provider accepts your case and responds to you in a clinical capacity. Providers may decline to issue a prescription if, in their judgment, the requested treatment is not appropriate for you. Nothing on the Site constitutes medical advice.
6. Compounded Medications — Important Information
Certain medications offered through the Services, including compounded tirzepatide, are prepared by a licensed compounding pharmacy for a specific patient pursuant to a valid prescription.Compounded medications are not approved by the U.S. Food and Drug Administration (“FDA”).The FDA does not review compounded medications for safety, effectiveness, or quality prior to dispensing. Compounded medications are not the same as, and should not be assumed to be equivalent to, any FDA-approved brand-name product. Side effects, contraindications, and risks apply, and are described in the Important Safety Information provided with each product and in the documentation that accompanies your shipment. You are responsible for reading this information carefully and discussing it with your provider.
7. Your Account
To use certain features, you must create an account. You agree to provide accurate, current, and complete information; keep your password and any login credentials confidential; and promptly notify us of any unauthorized use or suspected breach. You are responsible for all activity that occurs under your account. We may suspend or terminate your account for suspected misuse or violation of these Terms.
8. Accuracy of Medical Information
When you complete an intake, you agree to provide accurate and complete information about your identity, medical history, current medications, and any other information requested. Providing false or incomplete information may result in the inappropriate denial or issuance of a prescription and may cause you harm. If you knowingly submit false information, PepHaus reserves the right to cancel your order, suspend your account, and refuse to refund any amounts paid.
9. Orders, Pricing, and Payment
All prices are in U.S. dollars and may change at any time. Applicable sales tax will be added where required by law. Payment is due at the time of order. By submitting payment information, you authorize PepHaus and its payment processors to charge your payment method for the amount owed, including recurring subscription charges if applicable.
We reserve the right to refuse, cancel, or limit any order, including after an order has been placed, for reasons including but not limited to: pricing errors, product unavailability, suspected fraud, or clinical ineligibility. If an order is cancelled, we will refund any amount already charged.
10. Subscriptions and Automatic Renewal
IMPORTANT — SUBSCRIPTIONS RENEW AUTOMATICALLY. Unless you cancel before the next billing date, your subscription will continue indefinitely and we will charge your payment method at the then-current subscription price on each renewal date. You authorize these recurring charges by starting a subscription.
Subscription length, price, billing cadence, and the next charge date are disclosed during checkout and in your account dashboard. You may cancel or pause your subscription at any time from your account dashboard or by emailingsupport@thepephaus.com. Cancellation is effective at the end of the current billing cycle and avoids future charges. Cancellation does not retroactively refund the current cycle unless required by applicable law. Promotional, introductory, and trial pricing expires as disclosed at checkout, at which point regular pricing applies. Where required by state law (including California’s Automatic Renewal Law and similar statutes), we provide advance notice of price increases and renewal-reminder emails before each cycle.
11. Shipping, Delivery, and Risk of Loss
We ship within the United States only. Shipping times are estimates and are not guaranteed. Title and risk of loss pass to you upon delivery to the carrier’s destination address you provide. You are responsible for providing an accurate address and ensuring a safe delivery location. For lost, stolen, or damaged shipments, see ourRefund & Return Policy.
12. Refunds and Returns
Because prescription medications cannot be reused or resold after shipment for safety and regulatory reasons, sales are generally final once a medication has shipped. Exceptions — including clinical ineligibility, damaged or defective products, and lost shipments — are described in ourRefund & Return Policy, which is incorporated into these Terms.
13. Prohibited Uses
You agree that you will not:
Resell, redistribute, or divert any medication obtained through the Services to any other person;
Use the Services for any commercial purpose other than your own personal use;
Submit false or misleading information during any intake, consultation, or customer-service interaction;
Attempt to gain unauthorized access to any portion of the Services, including other users’ accounts;
Scrape, mirror, or otherwise use automated means to extract data from the Site without our written consent;
Use the Services to violate any applicable federal, state, or local law, including controlled-substance laws, or to engage in fraud;
Interfere with or disrupt the Services, servers, or networks connected to the Services;
Upload, transmit, or make available any content that is unlawful, defamatory, obscene, infringing, or otherwise harmful.
14. Intellectual Property
All content on the Site, including text, graphics, logos, images, audio, video, interfaces, trademarks, and software, is the property of Pephaus LLC or its licensors and is protected by U.S. and international intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial use, subject to these Terms. Any other use requires our prior written consent.
15. User Content
You retain ownership of content you submit to the Services (for example, reviews or feedback). By submitting content, you grant PepHaus a worldwide, royalty-free, sublicensable, perpetual license to use, reproduce, distribute, create derivative works from, and display that content in connection with the Services and our business. You represent that you have all rights necessary to grant this license and that your content does not violate any law or the rights of any third party.
16. Copyright Complaints (DMCA)
If you believe that content on the Site infringes your copyright, please send a DMCA notice tosupport@thepephaus.comwith the information required under 17 U.S.C. § 512(c)(3), including your contact information, a description of the work allegedly infringed, the location of the allegedly infringing content on our Site, and a statement under penalty of perjury that you are authorized to act on behalf of the copyright owner.
17. Third-Party Services
The Services may link to or rely on third-party services, including payment processors (e.g., Stripe), electronic-health-record providers, pharmacies, carriers, and analytics providers. We are not responsible for the content, policies, or practices of any third party. Your interactions with third parties are governed by their respective terms and privacy policies.
18. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. WITHOUT LIMITING THE FOREGOING, PEPHAUS MAKES NO WARRANTY REGARDING ANY SPECIFIC MEDICAL OUTCOME, WEIGHT-LOSS RESULT, OR OTHER HEALTH OUTCOME.
19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEPHAUS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICES, EVEN IF PEPHAUS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO PEPHAUS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
20. Indemnification
You agree to indemnify, defend, and hold harmless PepHaus and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Services, your violation of these Terms, or your violation of any right of a third party.
21. Dispute Resolution; Binding Arbitration; Class-Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS AND REQUIRES YOU AND PEPHAUS TO RESOLVE DISPUTES BY BINDING INDIVIDUAL ARBITRATION RATHER THAN IN COURT (WITH LIMITED EXCEPTIONS), AND WAIVES THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.
Informal Resolution. Before initiating arbitration, you and PepHaus agree to attempt to resolve any dispute in good faith by notice to the other party describing the nature and basis of the claim and proposed relief. Send any notice to PepHaus atsupport@thepephaus.com. If the dispute is not resolved within 30 days, either party may proceed to arbitration.
Binding Arbitration.Any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect. The arbitration will be conducted in Sheridan, Wyoming or, at your election, in your county of residence, and may be conducted by video where available. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
Class-Action Waiver. You and PepHaus agree to bring any claim only in your or its individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any class or representative proceeding.
Small-Claims Exception.Either party may bring an individual action in small-claims court for a dispute within that court’s jurisdiction, in lieu of arbitration.
Opt-Out Right. You may opt out of this arbitration agreement by emailingsupport@thepephaus.comwithin 30 days of first accepting these Terms, with the subject line “Arbitration Opt-Out” and your full name, email address, and postal address. Opting out will not affect any other provision of these Terms.
22. Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles. Subject to Section 21, the state and federal courts located in Sheridan County, Wyoming have exclusive jurisdiction over any dispute not subject to arbitration.
23. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including suspected violation of these Terms. Upon termination, the sections of these Terms that by their nature should survive (including Sections 6, 14, 18-22, and 26) will continue to apply.
24. Changes to These Terms
We may update these Terms from time to time. We will post the revised Terms on the Site with an updated effective date and, where required by law, provide additional notice. Your continued use of the Services after the effective date of any revision constitutes your acceptance of the revised Terms. If you do not agree to any revision, you must stop using the Services.
25. Electronic Communications & Signatures
By using the Services, you consent to receive communications from us electronically, and you agree that electronic signatures, contracts, and notices satisfy any legal requirement that such communications be in writing.
26. Miscellaneous
These Terms, together with the documents referenced in Section 1, constitute the entire agreement between you and PepHaus regarding the Services and supersede any prior agreements. If any provision is held unenforceable, the remaining provisions will remain in full force. We may assign these Terms without your consent; you may not assign them without our prior written consent. Our failure to enforce any right or provision is not a waiver. No agency, partnership, joint venture, or employment relationship is created by these Terms.
